The U.S. Department of State released the August 2026 Visa Bulletin on July 21, 2026. Movement across the employment-based categories is limited, with a one-month advance for China EB-1, a small advance for China EB-3, a one-month advance for worldwide EB-3, and continued restriction for India in EB-2.

The single biggest headline is India EB-2, which is marked “U” for unavailable and will issue no numbers for the remainder of fiscal year 2026. For applicants chargeable to almost every other country, including Nigeria and the rest of Africa, EB-2 remains Current.

EB-2 Movement Across Countries

China EB-2 is unchanged at September 1, 2021. India EB-2 is unavailable for the rest of the fiscal year. Every other country, Nigeria included, remains Current.

The State Department also flagged pressure on EB-2 worldwide. Rising demand may make it necessary to retrogress the final action date or make the category unavailable in the coming months to stay within the annual limit. In plain terms, a Current EB-2 date today is not guaranteed to stay Current, which raises the value of moving now.

EB-3 Movement Across Countries

China EB-3 advances ten days to January 1, 2022. India EB-3 holds at January 1, 2014. All other countries and Mexico advance one month to September 1, 2024. The Philippines holds at August 1, 2023.

For a non-oversubscribed country, EB-3 sits at September 1, 2024, which is close enough to the present that many recent filers are already current or nearly so.

EB-5 Movement Across Countries

EB-5 Unreserved is Current for all countries except China, which holds at December 1, 2016, and unavailable India. Every EB-5 set-aside category, covering rural, high unemployment, and infrastructure investment, is Current for all countries. For a Nigerian, Kenyan, Ghanaian, or other African applicant, the relevant column is All Chargeability Areas Except Those Listed. In that column, EB-1 and EB-2 are both Current, and EB-3 sits at September 1, 2024.

EB-2 for Non-Oversubscribed Countries Is Current

Current is the best status the bulletin offers. It means numbers are authorized for every qualified applicant regardless of priority date, so there is no queue to wait through before you can take final action.

Consider a Nigerian data scientist with an approved EB-2 petition and a priority date of March 2025. Under an oversubscribed country’s cut-off, she would wait years. In the All Other Countries column, she is Current in August 2026 and can move to final action now.
