I766 EAD Card Made Simple for 2026

I766

Form I-766, often searched as i766, is your work permit card. Most people call it an EAD card. USCIS sends it to you after they approve your Form I-765. The card proves you can work in the United States for a set time. It is not a visa. It is not a green card.

Maybe you already have this card. Maybe you want to apply. Maybe yours is about to expire. This guide covers all of it. What the card is, who needs it, how to get it, and what changed in 2026.

That last part matters this year. The rules for renewals changed. Much of the advice online is now out of date. Here you get the current facts.

What changed for the EAD in 2026 (read this first)

Do you have an EAD, or plan to renew soon? Start here. The newest rules change when you should file.

The end of the automatic extension for new renewals

Here is the old rule. When you filed your renewal on time, your work permit kept working on its own. You could keep your job while USCIS made your new card.

That changed on October 30, 2025. The Department of Homeland Security put out a new rule. It removed the automatic extension for most people who file a renewal on or after that date.

What does that mean for you? If you file now, your permission to work may end on the date printed on your card. That can happen even while USCIS is still working on your renewal.

There are two exceptions. If you filed your renewal before October 30, 2025, you may still keep the old extension of up to 540 days while you wait. And a few groups, like some Temporary Protected Status holders, follow their own rules.

Your case depends on your category and your filing date. Check the current USCIS guidance before you count on any extension.

The lesson is simple. File early. Do not expect the old safety net to cover you.

Shorter validity periods

USCIS also made many cards last for less time. In late 2025, they cut the longest validity for many categories to 18 months. Older guides say one to two years. That is out of date for most people now.

A shorter card means you renew sooner. Plan your dates with care.

Current 2026 filing fees

You do not pay for the I-766 by itself. You pay when you file Form I-765. The fee depends on your category and how you file.

For many people in 2026, the fee is $520 by mail or $470 online. Some pay less. A few pay nothing. Check the current USCIS fee schedule for your category before you send money.

What the i766 EAD card is and what it proves

Form I-766 is a small card, about the size of a credit card. It proves one thing. You can work in the United States for the time shown on the card.

The card does not give you a new status. It does not make you a green card holder. It shows that, right now, you can work.

Work permit and photo ID in one card

The card has your photo and your details. That means it works two ways. It is your work permit. It is also a photo ID.

Many people use it for everyday needs. You can use it to get a Social Security number, open a bank account, or apply for a driver’s license. You can do all of this while your bigger case moves along.

A List A document on Form I-9

When you start a job, your employer fills out Form I-9. This checks who you are and that you can work.

The EAD does both jobs at once. That makes it a “List A” document. You will not need to show a second ID with it.

What appears on your EAD card

Reading the card the right way helps you and your employer.

Front of the card

The front shows your name, your photo, and your date of birth. It also shows your Alien Registration Number. Most people call this the A-Number.

There is a category code too. It shows why you can work. You will also see the dates the card is good for. The expiration date sits in a box near the bottom. That date tells you if the card still works.

The two card numbers employers confuse

The card has two different numbers. People mix them up all the time.

One is your A-Number. That number stays with you. The other is the card number. It belongs to the card itself, not to you.

When you or your HR team write these down, put each number in the right box.

How to tell a card is valid

A good card is unexpired and matches you. Two quick checks help.

First, look at the expiration date on the front. Make sure it has not passed. Second, check that the name on the card matches your other IDs.

For a new job, an unexpired card is enough on its own. It is a List A document, so it covers both checks.

Form I-765 vs Form I-766, request versus result

This mix-up is the most common one. Let us make it clear.

Form I-765 is the form you file to ask for permission to work. Form I-766 is the card USCIS sends after they say yes.

One is the request. The other is the result. You never file Form I-766 on its own. You file Form I-765. If USCIS approves you, the I-766 card shows up in the mail.

Who needs an EAD and who does not

Not everyone who can work needs an EAD. Knowing your group can save you a fee and months of waiting.

Categories that must apply

You usually need to file Form I-765 when you must ask USCIS for permission to work.

Here are common examples. People waiting on a Form I-485 to get a green card. People waiting on a Form I-589 asylum case. Students on F-1 or M-1 visas who want to work, such as through Optional Practical Training.

Asylees and refugees also carry an EAD. For them, the card is proof of the right to work they already hold.

Who does not need one

Green card holders do not need an EAD. The green card already proves they can work.

Some visa holders do not need one either. This is true when your status lets you work for a set employer. It covers H-1B, L-1B, O, and P visa holders. Their right to work comes from the petition, not from a separate card.

Founders and executives, where the card fits

This part matters if you run a company or hold a senior role.

Say you have an O-1 visa for people with special skills. You do not need an EAD. The O-1 already lets you work for the company that filed for you. Your O-3 family members, though, cannot work at all.

Things change when you go for a green card. Say you file Form I-485 to adjust status through EB-1A, EB-2 NIW, or another path. You can file Form I-765 and get an I-766. That card lets you work while you wait. Here, the EAD is a bridge from your current status to your green card.

How to apply for Form I-766

Filing Form I-765, online or by mail

You apply by filing Form I-765. You can do it in your USCIS online account or by mail to the right address.

Online is often faster to send. It also costs a little less. And it lets you track your case in one place.

Check your category first. Your category sets your fee. It also decides if you qualify at all.

Biometrics and processing times

Many people go to a biometrics appointment. There, USCIS takes your fingerprints and a photo.

How long does approval take? It depends on your category and the office. Times also change through the year. Do not trust an old number. Check the current wait time on the USCIS website before you plan a date.

Renewing your i766 card in 2026

Renewal is where the 2026 changes hit hardest. Act on this section.

The 180-day filing window

USCIS lets you file your renewal up to 180 days before your card expires. That head start has a purpose. In 2026, it is your main way to avoid a gap in work permission.

Why filing early matters more now

Under the old rules, a late filer could often keep working on the automatic extension. That cushion is gone for most new filings now. If your renewal is still pending when your card expires, your right to work can just stop.

Here is a simple example. Your card expires on September 1. If you file at the start of the window, around early March, USCIS has the most time to approve your new card first. If you wait until August, you leave almost no room. One normal delay could cost you weeks of work.

Build a habit instead. The day your new card arrives, mark your renewal date. Then file as soon as the window opens.

Replacing a lost, stolen, or incorrect EAD

Maybe your card was lost, stolen, or damaged. Maybe it has a mistake on it. Either way, you ask for a new one by filing Form I-765 again and picking the replacement reason.

If USCIS made the mistake, you usually do not pay again. If the card was lost or stolen, a fee often applies. Report a stolen card. Keep your receipt notice, since it shows a new card is on the way.

What happens if your EAD expires

An expired card with no valid extension means you cannot keep working. You must wait for the new card first.

Employers face real risk if they let you work on an expired card. Most will stop your shifts the day it ends.

This is why renewal timing matters so much in 2026. A gap is not just a paperwork problem now. It can stop your income. File early. Track your case. Keep every receipt notice USCIS sends you.

Where the EAD fits in your bigger plan

An EAD lets you work today. It does not settle where you stand tomorrow.

For founders, leaders, and skilled workers, there is a bigger question. How do you get the status that makes your right to work permanent, not just temporary?

That is what Veripass does. We help skilled professionals and founders build a strong case for US residency. We focus on paths like EB-1A, EB-2 NIW, and O-1. Your right to work should rest on lasting status, not on a card you renew every 18 months.

Is Form I-766 the same as a green card?

No. Form I-766 only proves you can work for a set time. A green card gives you permanent residence. That means you can live and work in the United States for good. An EAD expires and needs renewal. A green card lasts much longer.

How long does an EAD take in 2026?

It depends on your category and how busy USCIS is. Times also shift during the year. Check the USCIS processing times page for a current number. Plan to file as early as your category allows.

Can I work while my renewal is pending?

It depends on your filing date and category. Did you file before October 30, 2025? Then you may still have the old extension of up to 540 days. Did you file on or after that date? Then your right to work may end on your card’s expiration date, even while you wait. Check your category before you count on it.

How do employers confirm an EAD is valid?

Your employer checks that the card is unexpired. They also check that the details match you. Then they record it as a List A document on Form I-9. An unexpired card covers both identity and work permission on its own.

Do O-1 or H-1B holders need an EAD?

No. O-1 and H-1B visa holders can already work for the company that filed for them. They do not need a separate EAD. The need usually comes later, when they file for a green card.
